Guide explains how to collect employer contributions

RP news wires, Noria Corporation

A fundamental responsibility of multiemployer benefit fund trustees is monitoring the accuracy and timeliness of employer contributions. Unfortunately, there are situations where trust fund representatives must take legal action in the pursuit of payroll information and delinquent contributions. The process can be time-consuming, confusing and filled with legal jargon.

“Collecting Employer Contributions: The ERISA Litigation Guide” is a step-by-step guide to the actions that comprise a collections lawsuit under the Employee Retirement Income Security Act of 1972 (ERISA).

Written by Travis Ketterman, an attorney with extensive experience pursuing trust fund collection cases, this new book explains the process from developing written procedures to collecting a court judgment.

“Often times trust funds do not take full advantage of the federal litigation process,” says Ketterman, a partner with the Chicago law firm of Whitfield McGann & Ketterman. “This book helps to demystify the federal courts and will persuade trust funds that full litigation of collections disputes through trial and possible appeal, may be within the best interest, and fiduciary obligation, of the fund.”

The book provides the information that trust funds need to collect the greatest amount of delinquent contributions. To help make the process easy to understand, the book breaks the litigation process into 63 specific actions.

The book also includes a helpful 200 page appendix with sample legal forms and other useful documents common to the collection of employer contributions

Administrators and fund trustees will find this book an ideal resource.
